Petition filed under Section 439 Cr.P.C.

Petitioner is the sole accused in Crime No. 1569 of 2013 of Pathanamthitta Police Station, registered for the offence punishable under Section 420 of the Indian Penal Code. 3.

The prosecution case is that he deceived the complainant by giving dollar cheques with the knowledge that he was not having sufficient money in his account. The petitioner caused loss to a tune of Rs.9,50,000/- lakhs to the de facto complainant. The petitioner was granted anticipatory bail by this Court earlier. He was directed to surrender the passport or if he had no passport, he should have filed an affidavit to that effect. In violation of the conditions, he left the Country and thereafter, he abstained from the court. He was arrested on 07.03.2015. 3.

Heard the learned counsel for the petitioner and learned Public Prosecutor.

Considering the nature of allegations and antecedents of the petitioner, following directions are issued:

B.A.No. 5083 of 2015 -: 2 :- 1)The petitioner shall be released on bail on his executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate having jurisdiction.

2)The sureties shall produce documents to reveal their identity and solvency.

3)The petitioner shall surrender his passport before the lower court concerned or if he does not have a passport, he shall file an affidavit and submit it before the court concerned.

4)The petitioner shall report before the Investigating Officer on alternate Sundays starting from 13.09.2015 for a three months.

5)The petitioner shall appear before the court below without fail.

6)He shall not leave the State without the permission of the court concerned.

If any of the above conditions in the bail order is violated by the petitioner, the court below is free to proceed with the cancellation of bail without referring the matter to this Court. Sd/- A. HARIPRASAD, JUDGE DST //True copy// P.A. To Judge
