Petition filed under Section 439 Cr.P.C.

Petitioners are accused 3 & 4 in OR No. 1 of 2015 of Kallar Forest Station. They are accused of having committed the offences under Sections 2(2), 2(16), 2(32), 2(36), 2(37), 39, 50 & 52 of the Wild Life Protection Act, 1972. They were found transporting tusks of an elephant.

Learned counsel submits that they have been in custody since 20.06.2015 and they may be granted bail. 4.

Learned Public Prosecutor submits that final report has already been filed. Having regard to the nature of the allegations, I am inclined to take the view that it is not in public interest to grant bail to the petitioners.
