Petition filed under Section 438 Cr.P.C.

Petitioner is involved in an offence punishable under Section 498A of the Indian Penal Code. He is the accused in Crime No. 535 of 2015 of Aryanad Police Station. 3.

The prosecution case is that the petitioner married the de facto complainant on 22.08.1996 and they were living as husband and wife. While so, he subjected the de facto complainant to mental and physical cruelty and he stabbed her on 17.04.2015 with a knife causing injuries.

Heard both sides.

Learned Public Prosecutor submitted that final report has already been filed in this case and the matter is pending before the Judicial First Class Magistrate, Nedumangad. Considering the nature of allegations and stage of the matter, following directions are made in this case.

(a)Petitioner shall surrender before the Magistrate having jurisdiction within a period of 'two weeks'

B.A.No. 5130 of 2015 -: 2 :- from today and execute a bond for Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two solvent sureties each for the like sum each to the satisfaction of the Magistrate. In that event, he shall be released on bail in Crime No.535 of 2015 of Aryanad Police Station.

(b)The petitioner shall appear before the Investigating Officer as and when required for the purpose of interrogation; if any required.

(c)He shall not intimidate or influence the witnesses. (d)He shall not get himself involved in any other criminal case while he is on bail.
