Petition filed under Sec.438 Cr.P.C.
2. Petitioner is the accused in Crime No.29 of 2015of Kassargod Railway Police station registered for the offences under Secs.308, 323, 324 and 341 read with Sec.34 of the Indian Penal Code. The prosecution case is that on 02.03.2015 at about 17.15 hours the petitioner along with the co-accused manhandled the defacto complainant while he was travelling in a passenger train. The accused persons also attempted to push the defacto complainant out of the train and thereby, they have committed the offence of culpable homicide as well.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. The petitioner had moved an application earlier for anticipatory bail as B.A. No.1900 of 2015. This court considered the matter and dismissed the application finding no reason to invoke the jurisdiction
Bail Appl. No.5156 of 2015 2 under Sec.438 Cr.P.C. I do not find any change of circumstances in this matter.
Therefore the bail application is dismissed.
