O R D E R
Application for bail under Section 439 Cr.P.C. 2.
Petitioner is the accused in O.R No.1/2015 of Narcotics Control Bureau, Cochin registered for offences punishable under Sections 8(c) r/w Section 21(c), 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short 'NDPS Act').
3.
Prosecution case, in short, is that on 05-02-2015, the Narcotic Control Bureau received a reliable information that a passenger coming to Thiruvananthapuram International Airport was carrying Heroin to export the same to Kuwait. On the basis of the tip off, a search conducted on the petitioner revealed that she possessed 1.06 Kg. of Heroine. After completing the formalities, she was arrested.
4.
Heard the learned counsel for the petitioner and the learned Public Prosecutor.
B.A No.5347 of 2015 2 5 .
Learned counsel for the petitioner contended that from 06-02-2015 onwards she remains in custody. Learned Special Public Prosecutor for Narcotics Control Bureau filed a counter to the bail application. He vehemently opposed the grant of bail to the petitioner. The quantity involved is a commercial quantity. Charge has already been filed in this matter. The matter is ripe for trial. Therefore, I do not find any reason to grant bail to the petitioner at this stage of the proceedings. Hence, the bail application is dismissed.
The learned Sessions Judge, Thiruvananthapuram shall take steps to expedite the trial and complete the same within a period of six months from today.
