Application filed under Section 439 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.580 of 2015 of Aryankode Police Station registered for the offences punishable under Section 8(a) r/w Section 21(b)(i) of NDPS Act. 3.
Heard the learned counsel for the petitioner and learned Public Prosecutor.

Prosecution case is that on 11.08.2015 at 15.50 hours, the Police party found out cultivation of ganja on the sunshade of the house of the accused. 11 ganja plants were planted in contravention of the provisions of the NDPS Act. 5.
The petitioner pleaded innocent. Investigation is not over. The offence alleged against the petitioner is very grave. 6.
Considering the stage of investigation, I do not find any reason to grant bail to the petitioner at this stage. Bail application is dismissed.
