Application filed under Section 438 of the Code of Criminal Procedure.
2.
Petitioner is the 2nd accused in Crime No.49 of 2015 of CBCID registered for the offences punishable under Sections 454, 380 and 461 of the Indian Penal Code. 3.
Petitioner's husband, the first accused was working as Attender in Punjab National Bank, Calicut Main Branch. It is alleged that he unlawfully opened the chest and locker in custody of the Bank and removed gold ornaments.
4.
Prosecution allegation is that gold ornaments were pledged in the name of the petitioner too. 5.
Heard the learned counsel for the petitioner and learned Public Prosecutor.
6.
Learned counsel for the petitioner contended that the petitioner is innocent. Her connection with the crime is only on the fact that some ornaments had been pledged in her name. There is no case for the prosecution
that she had appropriated any ornaments for herself. Nothing is to be recovered from her possession. 7.
Considering the stage of investigation, I am inclined to grant anticipatory bail to the petitioner with the following conditions:
(a) Petitioner shall surrender before the Dy.S.P. CBCID EOW-III, within a period of 'two weeks' from today and submit herself for interrogation. Thereafter, she shall be released on bail on her executing a bond for `50,000/- (Rupees Fifty Thousand Only) with two solvent sureties for the like sum to the satisfaction of the Dy.S.P. CBCID EOW-III.
(b) The petitioner shall appear before the Investigating Officer as and when required for the purpose of interrogation.
(c) The petitioner shall co-operate with the investigation of the case.
(d) The petitioner shall not intimidate or
attempt to influence the witnesses.
(e) The petitioner shall not in any manner interfere or meddle with the investigation.
(f) Petitioner shall not, during the period of this bail get involved in any offence.
In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
