O R D E R

Application for pre-arrest bail under Section 438 Cr.P.C. 2.

Petitioner is the 4th accused in Crime No.2246 of 2014 of Kunnamkulam Police Station registered for offences punishable under Sections 489A, 489B, 489C, 489D and 489E of I.P.C.

Prosecution case, in short, is that the petitioner handed over 7 counterfeit currency notes of Rs.500 denomination to the first accused to be deposited in a bank. Feeling suspicion, the Bank Manager informed the police and the first accused was taken to custody. Later, accused Nos.2 and 3 were arrested. They confessed the complicity of the petitioner in the crime.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned counsel for the petitioner submitted that

B.A No.5440 of 2015 2 there is no material to link the petitioner with the crime, except the confession of the co-accused . Learned Public Prosecutor submitted that look out notice has been published against the petitioner. Considering the nature of allegations and the financial implication of such matters on the economic strength of the nation, I am not inclined to grant pre-arrest bail to the petitioner. Hence, following directions are issued : The petitioner shall surrender before the Investigating Officer within a period of one week from today and submit himself for interrogation. Thereafter, he shall be produced before the learned Magistrate having jurisdiction on the same day. The petitioner is free to move for regular bail before the court below. In that event, the application shall be considered on merits as expeditiously as

B.A No.5440 of 2015 3 possible. If petitioner does not surrender in the stipulated time, the Investigating Officer is free to arrest him as if no order is passed in this matter.
