O R D E R
Petition filed under Sec.438 of Cr.P.C.
2. Petitioner is the accused in Crime No.1067 of 2015 of Nedumangad Police station registered for the offences punishable under Secs.323, 354 and 451 of the Indian Penal Code. The prosecution case is that on 13.07.2015 at about 9.00 p.m., the petitioner, due to previous enmity towards the defacto complainant and her family, trespassed into her house and beat the defacto complainant after catching hold of her.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
After hearing learned counsel on both sides and on a perusal of the records, I am of the view that the bail application can be disposed of with the following directions.
1. The petitioner shall surrender before the investigating officer within a period of two weeks and submit himself for
Bail Appl. No.5446 of 2015 2 interrogation.
2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.
3. He shall appear before the investigating officer on all Mondays between 9.00 am and 10.00 am until final report is filed.
4. He shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
5. He petitioner shall not involve in any other offence during the period of bail.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
