O R D E R
Petition filed under Sec.438 Cr.P.C.
2. Petitioner is the 10th accused in Crime No.232/CR/EOW/II/Kottayam/13 of the CBCID, Economic Wing II, Palakkad, which was originally registered as Crime No.663 of 2013 of Ottapalam Police station registered for the offence under Sec.420 read with Sec.120 of the Indian Penal Code. The prosecution case is that CEE VEE Global Trade Solutions Limited company made false promise that it would give high interest for the amount deposited with it and on the said promise, the company received huge deposit from the public. Accused nos.1 to 4 were the Directors of the company. The petitioner was a promoter of the company.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. Learned counsel for the petitioner submitted that the petitioner was mislead to believe the words of
Bail Appl. No.5540 of 2015 2 the Directors and the petitioner also invested money in the company. He is only a victim.
5. In similar cases, this Court had already granted the relief under Sec.438 Cr.P.C. as is evident from Annexures-B and C. In the said circumstances, I am of the view that the present application can also be allowed.
In the result, this bail application stands allowed and the petitioner shall be released on bail in the event of his arrest in Crime No.232/CR/EOW/II/ Kottayam/13 of the CBCID, Economic Wing II, Palakkad (Crime No.663 of 2013 of Ottapalam Police station) on condition of the petitioner executing a bond for Rs.1 lakh with two solvent sureties each for the like sum to the satisfaction of the Deputy Superintendent of Police, CBCID before whom the petitioner shall surrender within ten days, if not already arrested and subject to the following conditions.
1. The petitioner shall report before the investigating officer as and when directed by
Bail Appl. No.5540 of 2015 3 the investigating officer in writing for interrogation.
2. The petitioner shall surrender his passport before the lower Court concerned or if he does not have the passport, he must file an affidavit to that effect.
3. He shall not leave India without the previous permission of the Court below.
4. He shall not destroy or tamper with evidence.
5. He shall not get involved in any similar offence during the period of bail.
6. He shall not intimidate or influence the witnesses.
7. He shall co-operate with the investigation of the case.
