O R D E R

Petition filed under Sec.438 Cr.P.C.

2. Petitioner is the accused in Crime No.557 of 2005 of Central Police station, Ernakulam registered for the offences punishable under Secs.406 and 420 of the Indian Penal Code. After investigation, final report has been filed before the Court and the case is taken on file by the Chief Judicial Magistrate, Ernakulam as C.C. No.345 of 2005. The petitioner was released on bail by the Court.

3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

4. It is submitted by the learned counsel for the petitioner that the petitioner could not attend the Court due to lack of communication from the counsel. The petitioner did not willfully abstain form the Court.

5. Considering the nature of allegations, following directions are issued.

Bail Appl. No.5574 of 2015 2

1. The petitioner shall, within a period of one week surrender before the Chief Judicial Magistrate, Ernakulam, and execute a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Chief Judicial Magistrate. In that event, she shall be released on bail in the above case.

2. The petitioner shall appear before the Court without fail on all posting dates.

3. She shall not tamper with the evidence.

4. If she does not surrender in the stipulated time, this order will automatically cease to operate.

If any of the above bail conditions is breached, the learned Chief Judicial Magistrate is free to cancel the bail without referring the matter to this Court.
