Application filed under Section 439 of the Code of Criminal Procedure.

Petitioner is the 5th accused in Crime No.1207 of 2015 of Koippuram Police Station registered for the offences punishable under Sections 143, 147, 148, 453, 120(B), 427, 294(b), 323, 324, 506(ii), 153(A) r/w Section 149 of the Indian Penal Code.

The petitioner was arrested on 29.08.2015 and ever since he has been in custody.

Heard.

Learned Public Prosecutor has no serious objection in granting bail to the petitioner. It has been submitted by the learned Public Prosecutor that the other accused persons, who were arrested in this case on the same day, had been released by the learned Magistrate yesterday.

Considering the facts and circumstances of the

case, I am of the view that the further detention of the petitioner is not necessary in this case.

In the result, this petition stands allowed.

The petitioner shall be enlarged on bail on his executing a bond for `30,000/- (Rupees thirty thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Court of the Chief Judicial Magistrate, Pathanamthitta and subject to the following further conditions:

(a) The petitioner shall report before the Investigating Officer on every Monday between 09.00 a.m and 11.00 a.m. for a period of 'three months' or until filing of the final report, whichever is earlier.

(b) The petitioner shall not get involved in any offence while on bail.

(c) The petitioner shall not enter into the local limits of Koippuram Police Station until the filing of the final report without the leave of the learned magistrate, except for the

purpose of reporting before the Investigating Officer as directed in this order.

(d) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Officer or temper with the evidence.
