O R D E R

The petitioners are the accused Nos.1 and 2 in Crime No.1191/2015 of the Kochi Kasba Police Station. The said crime was registered against the petitioners alleging commission of offence punishable under S.294B, 323, 341, 406, 420 & 498A read with S.34 of Indian Penal Code. 2.

The allegation is that the first petitioner had married the de-facto complainant Smt.Beema Muthu on 08.03.1987 and 2 children were born in the said wedlock. Subsequently, the marital relationship got strained and the same was severed by pronouncing Talaq. Thereafter, the first petitioner married the second petitioner. Aggrieved by the above fact, the former wife has set the law in motion and has got the crime registered.

When the mater came up for hearing, the learned Public Prosecutor submitted that the final report has already been laid before court. There is no question of any imminent threat of arrest. The learned Counsel appearing for the petitioner in the said circumstances submitted that he shall approach the trial court and move appropriate application for bail.

In view of the above submission the Bail application is disposed of permitting the petitioner to approach the learned magistrate and to seek regular bail in accordance with law.
