ORDER

Accused in Crime No.184 of 2014 of Kasaragod Police Station registered for offences punishable under Sections 420 and 406 of the Indian Penal Code seeks pre-arrest bail under Section 438 of the Code of Criminal Procedure.

Heard both sides.

Learned Prosecutor submitted that after investigation charge has been filed before the Chief Judicial Magistrate Court, Kasaragod and the matter is pending as C.C. No.514 of 2014. It is also submitted that steps under Sections 82 and 83 of the Code of Criminal Procedure have been taken in this matter as the accused was absconding from the court. After hearing the learned counsel on both sides, I am not inclined to grant anticipatory bail to the petitioner. Hence the following order:

Petitioner shall surrender before the court having jurisdiction and move for bail. In that event, the court below shall consider the application for bail on merits as expeditiously as possible. Application is disposed of.
