ORDER

Petition under Section 438 of the Code of Criminal Procedure. 2.

Petitioners are the accused in Crime No.1920 of 2015 of Mathilakam Police Station registered for offences punishable under Sections 452, 427, 506(i) and 294(b) read with Section 34 of the Indian Penal Code.

Prosecution case is that on 21.08.2015 at 8.00 p.m. the petitioners trespassed into the house of the defacto complainant and destroyed the window panes. They abused and threatened the defacto complainant of physical harm.

Heard both sides.

Considering the nature of allegations and the facts and circumstances, pre-arrest bail is granted to the petitioners with following conditions:

i.

Petitioners shall surrender before the investigating officer within a period of one week and submit themselves for interrogation. Thereafter each one of them shall execute a bond for `50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the

BA No.5851/2015 satisfaction of the investigating officer. In that event, they shall be released on bail in Crime No.1920 of 2015 of Mathilakam Police Station. ii.

The sureties shall produce documents to establish their identity and solvency.

iii.

Each one of the petitioners shall deposit `3,500/- (Rupees three thousand and five hundred only) within one from the date of execution of bond before the Magistrate having jurisdiction. iii.

Petitioners shall appear before the Investigating Officer on all Sundays between 10.00 and 11.00 a.m. until further orders. iv.

They shall not influence or intimidate the witnesses. In case of violation of any of the above conditions, the officer concerned is free to arrest the petitioners as if no order is passed. A. HARIPRASAD, JUDGE.
