O R D E R

This is an application filed under Section 439 of the Code of Criminal Procedure.

The petitioner is the accused in Crime No.356 of 2015 of Vidyanagar Police Station registered under Section 55 (i) of the Abkari Act, on the allegation that on 11.08.2015 at about 04.50 p.m., the petitioner was found transporting 101 liters of Indian Made Foreign Liquor in different bottles and 12 bottles of beer for the purpose of sale in contravention of the provisions of the Abkari Act. The petitioner was arrested from the spot and ever since, he has been in custody.

The learned Public Prosecutor has no serious objection in granting bail to the petitioner. It has been submitted by the learned Public Prosecutor that final report has already been filed in this case after completing

B.A.No.5862 of 2015 the investigation.

Considering the facts and circumstances of the case, I am inclined to grant bail to the petitioner. In the result, this application stands allowed and the petitioners shall be enlarged on bail on his executing a bond for `30,000/- (Rupees thirty thousand only) with two solvent sureties each for the like sum to the satisfaction of the Court of the Judicial Magistrate of First Class-I, Kasaragod and subject to the following further conditions:

(a) The petitioner shall not get involved in any offence while on bail.

(b) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.
