Application for bail under Section 439 Cr.P.C. 2.

Petitioner is the accused Nos.1, 3 and 4 in Crime No.803/2015 of Mala Police Station registered for offences punishable under Sections 143, 147, 148, 341, 323, 324 and 308 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

As per order dated 01-10-2015, this Court called for a report from the learned Magistrate having jurisdiction. Report dated 06-10-2015 by the learned Magistrate of Judicial First Class Magistrate Court, Chalakkudy is placed before me for perusal. It is seen that final report in the case was filed on 28-09-2015 and the case was taken on file on 29-09-2015. The matter is now pending in Committal Proceedings as C.P

B.A No.5867 of 2015 2 No.71/2015 and stands posted to 14-10-2015 for appearance of the accused. Therefore, the petitioners are free to move the committal court for bail and the court shall consider the bail application on merits with reference to powers under Section 437 Cr.P.C.
