ORDER
Bail application filed under Sec.438 Cr.P.C.
2. The petitioner is the 1st accused in Crime No.763 of 2014 of Dharmadam Police Station seeks pre arrest bail. It is alleged that on 17.06.2014, a tax receipt purported to be genuinely obtained, was produced before the Village Officer for effecting a mutation. On verification, it was found that the document is a forged one. Therefore the complaint was filed alleging the offence punishable under Sections 420, 468 and 471 of the IPC. The petitioner is said to be a person involved in fabrication of the false document.
3. Heard both sides.
4. The learned Counsel for the petitioner submitted that he has no connection with Smt.Renuka, who allegedly produced a false document before the Village Officer. He is a document writer by profession.
5. Learned Public Prosecutor submitted that the prosecution case is that with this petitioner's connivance
the document was forged.
6. Considering the nature of allegations, following directions are issued.
1. The petitioner shall surrender before the investigating officer within a period of one week and submit himself for interrogation.
2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.
3. The petitioner shall appear before the Investigating Officer as and when directed by him in writing.
4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
5. The petitioner shall co-operate with investigation of the case.
In case of violation of any of the above
conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
