Petitioner is the accused in Crime No.753 of 2015 of Kelpeta Police Station registered for the offences punishable under Sections 406, 420 and 506(ii) r/w Section 34 of the Indian Penal Code.

Heard both sides.

Even though the order passed by the learned Judicial First Class Magistrate, Kalpetta shows the said crime number, learned Public Prosecutor submitted that the offences involved in Crime No.753 of 2015 of the Kalpetta Police Station are under Sections 366A and 376 (2)(i) of the Indian Penal Code and Sections 3 and 4 of the Protection of Children from Sexual Offences Act. The petitioner has no case that he is involved in such offences. Therefore, in the absence of correct crime
