ORDER

Petition under Section 438 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.185 of 2015 of Maloor Police Station registered for offences punishable under Sections 7, 9(f) r/w Section 10 of Protection of Children from Sexual Offences Act.

Prosecution case, in short, is that on 05-06-2015 at about 9.00 a.m., while the petitioner was working as a teacher in Madrassa committed sexual assault on a girl by touching her private parts inside the room in a mosque and thereby committed the aforementioned offences.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

I have perused the case diary. Materials in the case diary disprove prima facie the plea of total innocence raised by
