Application for pre-arrest bail under Section 438 Cr.P.C. 2.

Petitioners are accused in Crime No.1472/2015 of Kodungallur Police Station registered for offences punishable under Sections 3(1)(e) of the Prevention of Damage to Public Property Act.

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

The incident was on 11-06-2015 at about 13.00 hours. Prosecution alleged that the petitioners caused damages to the newly constructed flooring tiles of a Taluk Hospital, Kodungallur after destroying the barricades.

Learned counsel for the petitioners submitted that they are political leaders of high repute in the area. Learned Public Prosecutor submitted a report showing that each of the

B.A No.6091 of 2015 2 petitioners is involved in a series of grave crimes. I do not find that this is a fit case to extent the extra ordinary jurisdiction of granting pre-arrest bail to the petitioners. Hence, the bail application is dismissed.
