Application filed under Section 439 of the Code of Criminal Procedure.

Petitioner is the accused in Crime Nos.372 of 2015 of Thalassery Police Station, 1036 of 2015 of Kunnamangalam Police Station, 676 of 2015 of Thamarassery Police Station and 1202 of 2015 of Manjery Police Station registered under Sections 406 and 420 of the Indian Penal Code.

Common allegation is that the petitioner is the Managing Director of Sree Janatha Akshaya Chits Pvt. Ltd., Kunnamangalam, Calicut. Prosecution contended that he conducted unauthorized business through various branches in the State of Kerala. It is the allegation that the chitty conducted by the petitioner was closed causing loss to subscribers to a tune of various amounts. 4.
Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned counsel for the petitioner submitted that the petitioner is innocent of all the allegations. It is also submitted that the petitioner is the Managing Director of registered Company running the business in chit funds. There is no violation of any law according to him. However, the fact remains that there are lot complaints filed against him by various persons in various Police Stations. Originally he was arrested by Balussery Police. He has been released on bail as per common order dated 29.09.2015 in B.A.Nos.5650, 5816 and 5820 of 2015.

Considering the stage of investigation, I am inclined to grant bail to the petitioner with the following same conditions:
(a) The petitioner shall be released on bail on his executing bonds for `25,000/- (Rupees twenty five thousand only) in each case with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate having jurisdiction.
(b) The sureties shall be the persons permanently residing in the State of Kerala and shall produce documents to establish their identity and solvency.
(c) The petitioner shall appear before the Investigating Officer between 10.00 a.m.
and 11.00 a.m. on once in a two weeks until final report is filed.
(d) The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
(e) The petitioner shall not involve in any other offence during the period of bail.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
