Application filed under Section 438 of the Code of Criminal Procedure.

Petitioner is the first accused in Crime No.1320 of 2015 of Cantonment Police Station registered for the offences punishable under Sections 323, 324 and 354 r/w Section 34 of the Indian Penal Code.

Prosecution allegation is that on 29.08.2015 at 17 hours, the petitioner along with other accused attacked the husband of the defacto complainant, a lady, on account of a dispute. When the defacto complainant tried to save him, the petitioner along with other accused assaulted her and her daughter.

Heard both sides.

Leaned counsel for the petitioner submitted that his plea for pre-arrest bail raised before Sessions Court was dismissed finding that the petitioner is involved in other crimes.

Leaned Public Prosecutor on instructions submitted that the other crime registered against the petitioner is only under Section 323 of the Indian Penal Code.

Considering nature of allegations and stage of investigation, I am inclined to grant bail to the petitioner with the following conditions:
(a) In the event of arrest of the petitioner in Crime No.1320 of 2015 of Cantonment Police Station, he shall be released on bail on executing a bond for `25,000/- (Rupees Twenty Five Thousand Only) with two solvent sureties for the like sum to the satisfaction of the Investigating Officer.
(b) The petitioner shall appear before the Investigating Officer as and when required for the purpose of interrogation.
(c) The petitioner shall not intimidate or attempt to influence the witnesses.
(d) The petitioner shall not in any manner interfere or meddle with the investigation.
(e) The petitioner shall not, during the period of this bail get involved in any offence.
In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
