Application for pre-arrest bail under Section 438 Cr.P.C. 2.
Petitioner is the first accused in Crime No.182/CR/511/07 of CBCID SIG II, Ernakulam originated from Crime No.573/2007 of Hill Palace Police Station registered for offences punishable under Sections 489A, 489B, 489C and 489D r/w Section 34 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned Public Prosecutor strongly opposed the bail application. It is stated that final report in this case has already been filled and a warrant is pending against the petitioner. Therefore, the petition can only be viewed as an abuse of the process of court. Hence, the bail application is dismissed.
