Application filed under Section 438 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.127 of 2015 of Kayamkulam Excise Range registered for the offence punishable under Section 55(i) of the Abkari Act. 3.

Prosecution allegation is that on 21.09.2015 at about 11.20 A.M., the petitioner was found in possession of 600 ml of IMFL and Rs.60/- allegedly the sale consideration of the liquor.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Leaned Public Prosecutor opposed the bail application. It submitted that the petitioner is involved in a similar offence earlier.

6. Considering the nature of allegations and the

B.A.No.6336 of 2015 provisions in Section 41A of the Abkari Act, I am not entitled to grant anticipatory bail.

The bail application is dismissed.
