O R D E R

Application for pre-arrest bail under Section 438 Cr.P.C. 2.

Petitioners are accused Nos.3 and 4 in Crime No.1526/2015 of Peramangalam Police Station registered for offences punishable under Sections 20(b) ii(A) of Narcotic Drugs and Psychotropic Substances Act and Section 27 of the Arms Act.

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

Prosecution case, in short, is that on 05-09-2015 at about 6.15 p.m., on an information received by the police, they went to the informed place. On seeing the police, the petitioners ran away from the place. First and second accused were arrested from the spot and they were found in possession of ganga. It is

B.A No.6337 of 2015 2 also alleged that the accused persons possessed deadly weapons like sword, iron rod etc.

Learned counsel for the petitioners submitted that they are falsely implicated in the case. Learned Public Prosecutor strongly opposed the bail application contending that the petitioners' name were revealed at the first instance and they were armed with deadly weapons. 3rd accused is involved in two cases and 4th accused is involved in three other cases. Learned Public Prosecutor further submitted that they are booked under Section 107 Cr.P.C and they are in the rowdy list also. Therefore, I am not inclined to grant pre-arrest bail to the petitioners. Hence, the bail application is dismissed. Sd/- A.HARIPRASAD, JUDGE.
