ORDER

Bail application filed under Sec.438 Cr.P.C.

2. The petitioner is the 2nd accused in Crime No.663 of 2015 of Irinjalakuda Police Station registered under Sections 120(b), 417, 420, 468 read with 34 of IPC.

3. The petitioner is the Director of a Company. The prosecution case is that without knowledge and consent of the shareholders, he transferred the shares of the de facto complainant and others with an intention to cheat them.

4. Heard the learned Counsel for the petitioner and the learned Counsel appearing for the de facto complainant.

5. Considering the nature of allegations and after hearing all the parties, I am of the view that the custodial interrogation of the petitioner may not be necessary. Hence the following directions are issued.

1. The petitioner shall surrender before the investigating officer within a period of one week

Bail Appl. No.6384 of 2015 and submit himself for interrogation.

2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.

3. The petitioner shall appear before the Investigating Officer as and when directed by him in writing.

4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.

5. The petitioner shall co-operate with investigation of the case.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
