ORDER
Application under Section 438 of the Code of Criminal Procedure.

Petitioner is the eighth accused in NDPS Crime No.21 of 2015 of Excise Enforcement and Anti Narcotic Special Squad, Ernakulam. It is alleged that he is falsely implicated in the case. 3.
Heard both sides.

Learned counsel for the petitioner submitted that there is absolutely no connection for the petitioner with the crime. 5.
Learned Prosecutor strongly opposed the bail application contending that this is a case wherein 1.615 kgs. of brown sugar was recovered from accused 1 to 3. Subsequent investigation has revealed the complicity of other accused. Petitioner is arrayed as eighth accused. Case diary is produced for perusal. Confession statements extracted from the arrested accused reveal the complicity of the petitioner. Whatever be the evidenciary value of such statements, considering the nature and gravity of offences, I am not inclined to
BANo.6417 of 2015 entertain the application under Section 438 of the Code of Criminal Procedure for pre-arrest bail. Therefore, the application is dismissed. A. HARIPRASAD, JUDGE.
