ORDER

Bail application filed under Sec.438 Cr.P.C.

The petitioner is the accused in Sreekrishnapuram Police Station crime No.697/2015 registered under Section 67A of the Information Technology Act and Section 506 of IPC.

3. The prosecution case is that, the petitioner posted phonographic photos and obscene messages of the daughter of the de facto complainant in the facebook.

4. Heard the learned Senior Counsel for the petitioner and the learned Counsel appearing for the de facto complainant and the learned Public Prosecutor.

5. All the parties had submitted that, the matter has been settled. The petitioner has made arrangement to marry the daughter of the de facto complainant.

6. Considering the subsequent developments,

pre arrest bail is granted to the petitioner with the following directions are issued.

1. The petitioner shall surrender before the investigating officer within a period of one week and submit himself for interrogation.

2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.

3. The petitioner shall appear before the Investigating Officer as and when directed by him in writing.

4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.

5. The petitioner shall co-operate with investigation of the case.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
