Bail application filed under Sec.438 Cr.P.C.

2. Petitioner seeks pre arrest bail in Crime No.369 of 2014 of Chathannoor Police station registered for the offence punishable under Sec.174 Cr.P.C. Prosecution case is that one lady committed suicide leaving behind a suicide note accusing her husband as the person responsible for her suicide.

3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

4. Learned counsel for the petitioner submitted that the petitioner is no way connected with the incident. According to him, the Police is persecuting the petitioner unnecessarily.

5. Learned Public Prosecutor submitted that at present, the petitioner is not an accused in this crime. Therefore, he is not wanted to be arrested.

It is made clear that in the event of the

Bail Appl. No.6510 of 2015 2 petitioner being made an accused in this crime, a notice under Sec.41A Cr.P.C. shall be issued and the investigating officer shall take appropriate steps thereafter.

With these observations, the bail application is closed.
