Application filed under Section 439 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.201 of 2015 of Neyyardam Police Station registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code and Sections 3, 4 and 5(1) of the Protection of Children from Sexual Offences Act. 2012. 3.
Prosecution case is that on 29.03.2015 at about 12 noon, he has abducted a minor girl, aged 13 years from the legal custody of her parents and took her to various places and subjected her to sexual abuse from 29.03.2015 to 02.04.2015.

Heard the learned counsel for the petitioner and learned Public Prosecutor.

Learned counsel for the petitioner submitted that his earlier bail application was rejected by this Court as per order dated 19.08.2015 in B.A.No.4855 of 2015.

Learned Public Prosecutor opposed the bail application.

Considering the facts and circumstances of the case and the nature of allegations, I do not find any change of circumstances warranting a change of view in this case. Therefore, this bail application is dismissed. Bail Application is dismissed.
