O R D E R
Application for pre-arrest bail under Section 438 Cr.P.C. 2.
Petitioner is the second accused in Crime No.950 of 2015 of Ponnani Police Station registered for offences punishable under Sections 406 and 420 r/w Section 34 I.P.C. The petitioner was the managing director of Veejika Chit Funds, a limited company. 3.
It is the submission of the petitioner that he resigned from the post of managing director of the company with effect from 11-11-2012. Annexure A is Form No.32 submitted before the Registrar of Companies indicating that he resigned from the company.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Allegation is that on 13-12-2012, the defacto complainant made deposit to the chit funds and later he lost his money. In similar matter, this court granted bail to the petitioner in B.A No.6531 of 2015 dated 18th November, 2015. Considering the
B.A No.6534 of 2015 2 nature of allegations, following directions are made : i.
In the event of arrest in Crime No.950 of 2015 of Ponnani Police Station, petitioner shall be released on bail on executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.
ii.
The sureties shall produce documents to establish their identity and solvency. The investigating officer shall not insist on the solvency certificate, but other documents can also be perused to find out whether the sureties are solvent or not.
iii.
Petitioner shall appear before the investigating officer as and when directed in writing and co-operate with the investigation in the matter.
iv.
He shall not influence or intimidate the witnesses. In case of violation of any of the above conditions, the officer concerned is free to arrest the petitioner as if no order is passed. Sd/- A.HARIPRASAD, amk JUDGE. //True copy// P .A to Judge
