ORDER
Bail application filed under Sec.438 Cr.P.C.
2.The petitioner is the 2nd accused in Melattoor Police Station crime No.636/2015 registered for the offences under Section 269 read with 34 IPC, Section 120 (e) of the Kerala Police Act, 2011 and Section 24 (1) read with 43 of the Water (Prevention and control of Pollution) Act 1974.
3. It is alleged that on 23.09.2015 at about 5.00 am, the 1st accused carried chicken waste in a vehicle and strewn it at public places with the help of other accused.
4. Heard both sides.
5. The learned Counsel for the petitioner submitted that other accused who had already been arrested were released on bail by the Court below. This petitioner apprehends arrest for the said offences.
6. Considering the nature of allegations and the
role played by the petitioner, following directions are issued.
1. The petitioner shall surrender before the investigating officer within a period of one week and submit himself for interrogation.
2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.
3. The petitioner shall appear before the Investigating Officer as and when directed by him.
4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
5. The petitioner shall co-operate with investigation of the case.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
