O R D E R

Bail applications filed under Sec.439 Cr.P.C.

2. Accused in Crime Nos.951 of 2015 and 833 of 2015 of Alathur Police station are the petitioners in B.A. Nos.6590 and 6606 of 2015 respectively. They are the petitioners in B.A. No.6656 of 2015, involved in Crime No.1094 of 2015 of Kollengode Police station. One of the accused in the above bail applications is the accused in Crime No.1011 of 2015 and 1012 of 2015 of Alathur Police station. The offences alleged are punishable under Secs.392 of the Indian Penal Code. It is alleged that the accused persons had committed a series of chain snatchings. In one case, the accused were arrested. On the basis of the confession, other cases were registered.

3. Heard the learned counsel for the petitioners and the learned Public Prosecutor.

4. Learned counsel for the petitioners submitted that the accused persons are in custody from

6606 & 6656 of 2015 2 01.09.2015 onwards.

5. Learned Public Prosecutor submitted that investigation has advanced to a considerable extent.

6. Considering the nature of allegations and the fact that investigation has advanced to a considerable extent, bail is granted to the petitioners with the following conditions.

i. Each of the petitioners shall be released on bail on each of them executing a bond for Rs.50,000/- (Rupees fifty thousand only) in each case with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate having jurisdiction.

ii. The sureties shall be the persons permanently residing in the State of Kerala and shall produce documents to establish their identity and solvency.

iii. The lower Court need not insist on solvency certificate.

Other documents revealing the solvency of the sureties can also

iv. The petitioners shall appear before the SHO, Alathur Police station on all Saturdays and shall appear before the SHO, Kollengode Police station on all Sundays for interrogation between 9.00 a.m. and 10.00 a.m. until final report is filed.

v. The petitioners shall not intimidate or attempt to influence the witnesses, nor shall they tamper with the evidence.

vi. The petitioners shall not involve in any other offence during the period of bail.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
