Learned Prosecutor submitted that the petitioner is not an accused in any of the crimes registered by the Parithippally Forest Station. Therefore, the application under Section 438 of the Code of Criminal Procedure is not maintainable. Hence the application is dismissed. If petitioner's presence is required for interrogation, notice under Section 41A of the Code of Criminal Procedure will be issued to him.
