Application for bail under Section 439 Cr.P.C. 2.
Petitioner is the first accused in Crime No.1473/2015 of Pudukkad Police Station registered for offences punishable under Section 55(a) and (i) of the Abkari Act and Section 118(i) of the Kerala Police Act.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Prosecution case, in short, is that on 30-09-2015 at about 10.00 p.m., the petitioner along with other accused was found in possession of illicit liquor and banned tobacco products in a car for the purpose of sale. The petitioner was arrested on the date of detection itself.

Learned Public Prosecutor submitted that final report has already been filed in this matter and the matter is pending
B.A No.6691 of 2015 2 committal. Therefore, the petitioner is permitted to move the court, where the final report is filed, for regular bail. In that event, the lower court shall consider the matter on merit as expeditiously as possible.
