Application filed under Section 438 of the Code of Criminal Procedure.

Petitioner is the 3rd accused in Crime No.854 of 2015 of Edakkad Police Station registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 3 and 17 of the Protection of Children from Sexual Offence Act, 2012.

Prosecution case is that the first accused raped a minor girl, aged 14 years at the house where she was residing with her grandmother on 16.05.2015 and on 21.07.2015. Second accused also committed rape on her at his house with his wife's connivance. Wife of the second accused is the petitioner.

Heard both sides.

Learned Public Prosecutor submitted that the allegation against the petitioner is that she is guilty of offence under Section 17 of the Protection of Children from Sexual Offence Act, 2012.

Considering the nature of allegations, the following conditions are issued:
(a) Petitioner shall surrender before the Investigating Officer within a period of 'two weeks' from today and submit herself for interrogation. Thereafter, she shall be released on bail on her executing a bond for `50,000/- (Rupees fifty thousand only) with two solvent sureties for the like sum to the satisfaction of the Investigating Officer.
(b) The petitioner shall appear before the Investigating Officer as and when required for the purpose of interrogation.
(c) The petitioner shall co-operate with the investigation of the case.
(d) The petitioner shall not intimidate or attempt to influence the witnesses.
(e) The petitioner shall not in any manner interfere or meddle with the investigation.
(f) The petitioner shall not, during the period of this bail get involved in any offence.
In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
