O R D E R

Bail application filed under Sec. 438 Cr.P.C.

2. Petitioners are accused nos. 1 and 2 in Crime No.1403 of 2015 of Sooranadu Police Station, registered for the offences punishable under Secs. 143, 147, 148, 149, 294(b), 323, 324 & 452 read with Sec. 34 of the Indian Penal Code. The prosecution case is that on 17.10.2015, there was a scuffle between the members of two political outfits in regard to the fixing of posters.

3. Heard the learned counsel for the petitioners and the learned Public Prosecutor.

4. The learned counsel for the petitioners submitted that the petitioners are innocent in the above allegations.

5. The learned Public Prosecutor submitted that the

-2only non-bailable offence is under Section 452 IPC . Considering the nature of the allegations, the following directions are made :

1. The petitioners shall surrender before the investigating officer within a period of two weeks and submit themselves for interrogation.

2. In the event of arrest, the petitioners shall be released on their executing a bond for Rs.25,000/- (Rupees twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the investigating officer.

3. The petitioners shall appear before the Investigating Officer for interrogation on all Mondays and Thursdays between 10.00 a.m. and 11.00 a.m. until final report is filed.

4. The petitioners shall not intimidate or

-3attempt to influence the witnesses, nor shall they/he tamper with the evidence.

5. In that event, there shall be released on bail in Crime No.1403 of 2015 of Sooranadu Police Station.

6. The petitioners shall appear before the Investigating Officer as and when directed.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
