Application filed under Section 439 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.1476 of 2015 of Judicial First Class Magistrate, Payyannur registered for the offence punishable under Section 379 of the Indian Penal Code.

Prosecution case is that on 20.10.2015 at about 11.15 p.m., the petitioner attempted to snatch away the gold chain worn by the defacto complainant.

Heard both sides.

Learned Public Prosecutor submitted that after investigation a final report has been filed in this case. Considering the stage of the matter, I need not find any necessity to entertain this application by this Court. Instead the petitioner shall appear before the learned

B.A.No.6995 of 2015 Magistrate having jurisdiction. In that event, the learned Magistrate shall consider the matter on merits and pass appropriate orders as expeditiously as possible, if possible on the date of filing itself.
