ORDER

Application under Section 438 of the Code of Criminal Procedure.

Petitioner is the fourth accused in Crime No.2130 of 2015 of Chengannur Police Station registered for offences punishable under Sections 143, 147, 148, 323, 324 and 307 read with Section 149 of the Indian Penal Code and Section 27 of the Arms Act. He seeks pre-arrest bail.

Allegation is that on 28.08.2015, petitioner along with other accused persons armed with deadly weapons like sword stick, etc. as members of an unlawful assembly attacked the defacto complainant with an intention to commit murder. The specific allegation against the petitioner is that he used a sword stick to cause a grave injury on the head of the defacto complainant.

Learned counsel for the petitioner submitted that the petitioner is not involved in the incident.

The materials in the case diary do not support the contention

BA No.6996/2015 of the petitioner. Therefore, I am not inclined to grant pre-arrest bail to the petitioner. Application is dismissed.
