Applications filed under Section 438 of the Code of Criminal Procedure.

Petitioners are accused Nos.1 & 3 in Crime No.57 of 2011 of Iritty Police Station registered for the offences punishable under Sections 3 and 5 of the Explosive Substance Act.

Prosecution case is that on 26.01.2011 at about 08.00 p.m., country bombs possessed by the accused persons exploded and thereby, they committed the above said offences. It is submitted that the petitioners are workers of a political party.

Heard both sides.

Learned counsel for the petitioners submitted that so far the petitioners have not been arrested in the case.

On instructions, the learned Public Prosecutor submitted that the second accused was arrested and the

B.A.No.7060 of 2015 petitioners have evaded arrest.

Considering the nature of allegations, I am not inclined to grant anticipatory bail to the petitioners. Hence, the bail application is dismissed.
