Application filed under Section 438 of the Code of Criminal Procedure.

Eighth accused in Crime No.179/2015 of Vattapara Police Station registered under Sections 143, 147, 148, 149, 427, 323, 324 and 308 of the Indian Penal Code, seeks prearrest bail. 3.

Heard the learned counsel for the petitioner and learned Public Prosecutor.

4. The prosecution case in short is that, on 05-032015 at about 22.30 Hrs, the accused persons attacked the de facto complainant with an intention to commit culpable homicide.

5. Learned counsel for the petitioner relying on Annexure.5 Order on B.A.No.2660/2015, submitted that some other accused have been released on anticipatory bail by this Court. Further that the matter is said to be settled. Hence with the following directions.

(a) The petitioner shall be released on bail after

B.A.No.7218 of 2015 -:2:- interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.

(b) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing.

(c) He shall not destroy or temper with evidence.

In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
