ORDER
The petitioners are accused numbers 1 to 4, 7, 8 and 19 in Crime No. 800/CR/EOW-I/KLM registered for the offences under Sections 420 and 506 Part I read with Section 34 of the Indian Penal Code and Sections 3, 4 and 5 of Price Chits and Money Circulation (Banning) Act.
2. The petitioners have filed this petition praying for a relief under Section 438 Cr.P.C.
3. Heard.
4. The learned Public Prosecutor has no serious objection in allowing this petition. It has been submitted by the learned Public Prosecutor that some other accused, who had approached this Court, had been granted the relief under Section 438 Cr.P.C. Considering the facts and circumstances of the case including the fact that some of the accused persons had been already granted relief under Section 438 Cr.P.C. by this Court, I am inclined to grant the same relief to the petitioners as well, as the petitioners are also similarly placed.
In the result, this bail application stands allowed and the respondents are directed to release the petitioners on bail in the event of their arrest in connection with Crime No. 800/CR/EOW-I/KLM on condition of each of the petitioners executing a bond for Rs. 20,000/- (Rupees twenty thousand only) each, with two solvent sureties each, each for the like sum to the satisfaction of the second respondent, before whom the petitioners shall surrender within ten days from this day and subject to the following further conditions.
(1) The petitioners shall report before the Investigating Officer on every Monday between 9.00 and 11.00 a.m for six months or till the filing of the final report, whichever is earlier.
(2) The petitioners shall not intimidate or influence the witnesses or in any way tamper with the investigation.
(3) The petitioners shall not get involved in any offence during the pendency of the crime.
(4) The petitioners shall deposit their passport, if any, with the arresting officer simultaneously at the time of arrest or file an affidavit.
In the event of surrender of passport by the petitioners before the Investigating Officer, the Investigating Officer shall without delay produce the same before the Court. B. SUDHEENDRA KUMAR JUDGE DMR/-
