Application filed under Section 438 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.446 of 2015 of Kaliyar Police Station registered for the offences punishable under Sections 294(b), 456, 354(A), 354(C) and 506(ii) of the Indian Penal Code.

Prosecution allegation is that on 17.09.2015, the petitioner took photographs of the defacto complainant, a lady, from an obscene angle while she was working in the shop of the petitioner. Thereafter, on 18.09.2015, the petitioner demanded the defacto complainant to submit herself to satiate his sexual lust. On 22.09.2015, he embraced her from the shop and tried to outrage her modesty.

Learned counsel for the petitioner submitted that there is inordinate delay in filing the complaint. That apart, the defacto complainant and her husband was
B.A.No.7266 of 2015 managing the shop belonging to the petitioner and there was some monitory dispute. Petitioner is falsely implicated in the case.

I have perused the materials in the case diary. Statements of witnesses do not prompt me to grant anticipatory bail to the petitioner.
The bail application is dismissed.
