Application for pre-arrest bail under Section 438 Cr.P.C. 2.

Petitioner apprehends arrest in Crime No.1934 of 2015 of Aranmula Police Station.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned Public Prosecutor submitted that the accused is involved in offences punishable under Sections 279, 201 and 304A I.P.C and Section 134 (a) & (b) of the Motor Vehicles Act. There is no non bailable offence alleged against the petitioner. Hence, application under Section 438 Cr.P.C is not maintainable. In the result, the bail application is dismissed.
