Bail application filed under Sec.438 Cr.P.C.
2. Petitioner is the 1st accused in Crime No.908 of 2015 of Chokli Police station registered for the offences punishable under Secs.143, 147, 148, 323, 324, 354 and 308 read with Sec.149 of the Indian Penal Code. Prosecution case is that, on 29.09.2015 at about 11.30 hours, the petitioner along with other accused persons attacked the defacto complainant and his friend, a lady. It is alleged that the petitioner used a sword in the incident.
3. Heard the learned counsel for the petitioner, and the learned Public Prosecutor.
4. Learned Public Prosecutor opposed the bail application contending that the weapon used by the petitioner could not be recovered. It is also submitted that the petitioner is involved in another crime registered under Sec.307 IPC.
Bail Appl. No.7325 of 2015 2 Considering the nature of allegations and antecedents of the petitioner, I am not inclined to grant pre arrest bail to the petitioner.
