O R D E R

The petitioner is the accused in crime No.534 of 2014 of Alakode Police Station registered under Section 379 of I.P.C. The petitioner has filed this petition praying for the relief under Section 438 Cr.P.C.

2. Heard.

3. The learned Public Prosecutor has submitted that the Investigating Officer is likely to refer the matter as mistake of facts. However, no step has been so far taken to refer the matter. No report has been also filed before the Court in this regard.

BA 7266/2014 : 2 :

Considering the facts and circumstances of the case, including the submission of the learned Public Prosecutor, I am of the view that a direction can be issued to the respondent to release the petitioner on bail in the event of his arrest in Crime No.534 of 2014 of Alakode Police Station, on condition of the petitioner executing a bond for Rs.20,000/- (Rupees twenty thousand only) with two solvent sureties, each for the like sum to the satisfaction of the arresting officer and on further condition that the petitioner shall report before the Investigating Officer as and when required by the Investigating Officer for interrogation.
