ORDER
Application for pre-arrest bail under Section 438 Cr.P.C. 2.
Petitioner is the second accused in Crime No.1170 of 2015 of Palakkad Kasaba Police Station registered for offences punishable under Sections 143, 147, 148, 341, 323, 324 and 308 r/w Section 149 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Prosecution case in short, is that on 11-10-2015 at about 7.30 p.m., the accused persons in furtherance of their common object, formed into an unlawful assembly and attacked the defacto complainant with iron rod, sword, knife etc. and they intended to commit culpable homicide.

Learned Public Prosecutor opposed the bail application. She submitted that the petitioner is involved in three
B.A. No.7343 of 2015 2 crimes and a proceeding under Section 107 Cr.P.C. Allegation in this case is that he used a knife to inflict a stab injury. Considering the entire facts and circumstances of the case, I am not inclined to grant pre-arrest bail to the petitioner. Hence, the bail application is dismissed.
