Application filed under Section 438 of the Code of Criminal Procedure.

Fourth accused in Crime No.1233/2015 of Sooranadu Police station registered under Sections 143, 147, 148, 452, 294(b), 323, 324, 427 and 149 of the Indian Penal Code, seeks pre-arrest bail.
3. The prosecution case is that, the de facto complainant questioned the accused consuming alcohol in front of their house and in connection with that incident, he was attacked by using weapons.

Heard the learned counsel for the petitioner and learned Public Prosecutor.

Learned counsel for the petitioner submitted going by the allegations in the prosecution case, it can be seen that the petitioner had not used any weapon and he only fisted the de facto complainant. Reckoning the entire facts and circumstances pre-arrest bail is granted with following
B.A.No.7428 of 2015 -:2:- conditions:
(a) Petitioner shall surrender before the Investigating Officer within a period of 'two weeks' from today and submit themselves for interrogation. Thereafter, they shall be released on bail on he executing a bond for Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer.
(b) The petitioner shall appear before the Investigating Officer on all Saturdays between 10.00 a.m and 11.00 a.m. until the final report is filed.
(c) The petitioner shall co-operate with the investigation of the case.
(d) The petitioner shall not intimidate or attempt to influence the witnesses.
(e) The petitioner shall not in any manner interfere or meddle with the investigation.
B.A.No.7428 of 2015 -:3:- (f) Petitioner shall not, during the period of this bail get involved in any offence.
In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
