Application filed under Section 438 of the Code of Criminal Procedure.

Petitioner is the accused in Crime No.2578 of 2015 of Chingavanam Police Station registered for the offences punishable under Sections 326, 452, 506(ii) and 294(b) of the Indian Penal Code.

Prosecution allegation is that on 01.11.2015 at about 11.15 a.m., the petitioner trespassed into the restaurant run by the brother-in-law of the defacto complainant and attacked the victim with a chopper. He sustained very grave injuries. Actually the incident was on account of a property dispute between the petitioner and his brother. The person meddled with the matter is the brother-in-law of the petitioner's brother.

Learned Public Prosecutor opposed the bail application.

I have perused the wound certificate. It shows
B.A.No.7556 of 2015 that the victim sustained very serious injury on the left hand and fracture of ulna. The weapon of oppression is a chopper which has to be recovered.

Considering the nature of the allegations, I am not inclined to grant anticipatory bail to the petitioner. The bail application is dismissed.
